BOUGIE BURN — TERMS OF SERVICE Effective Date: August 15, 2026

1. Who These Terms Are Between

These Terms of Service ("Terms") are a legal agreement between you ("you," "your," or "customer") and Bougie Burn ("Bougie Burn," "we," "us," or "our"), a candle brand based in Vista, California. By visiting our website at bougieburn.com, placing an order, or using any part of our store, you agree to these Terms in full. If you don't agree, please don't use our site or purchase from us.

We're a small operation — real people, real candles, and a real person reading every email. These Terms exist to protect you and us, and we've written them in plain language on purpose.

2. Our Products

Bougie Burn candles are made to order in the United States with 100% natural soy wax, phthalate-free fragrance oils, and lead-free cotton wicks. Our designs are original to Bougie Burn; production and fulfillment are handled by our U.S. production partner. Every product description on our site is written to accurately represent each candle's scent, size, and burn time. We reserve the right to update, discontinue, or modify products and pricing at any time without notice.

Limited Drops are time-limited seasonal releases. When the run ends, they're gone. We do not guarantee restocks on Limited Drop or seasonal items, and all such purchases are final sale.

Candles carry inherent risk when used improperly. By purchasing from us, you confirm you have read and will follow our Candle Safety Guide at bougieburn.com/pages/candle-safety. Bougie Burn is not liable for damage, injury, or loss resulting from improper use of our products.

3. Orders & Payments

When you place an order, you represent that the information you provide — including your name, shipping address, and payment details — is accurate and complete. We reserve the right to cancel or refuse any order at our discretion, including if we suspect fraud or if an item is no longer available.

Orders are processed within 2–3 business days (Monday–Friday, excluding U.S. federal holidays). You'll receive a confirmation email when your order is placed and a shipping notification with tracking once it ships.

Prices are listed in U.S. dollars (USD). We are not responsible for any currency conversion fees charged by your bank or card provider.

4. Shipping

We currently ship to all 50 U.S. states, including Alaska and Hawaii. We do not offer international shipping at this time.

Standard Shipping: 5–8 business days
Expedited Shipping: 2–3 business days (rate calculated at checkout)
Free Standard Shipping: Included on every order — no minimum, no qualifying threshold

Delivery estimates are provided by carriers and are not guaranteed. Bougie Burn is not responsible for carrier delays due to weather, volume surges, or other circumstances outside our control.

If your package is lost or arrives damaged, email us at abzaa2021@gmail.com with your order number and photos within 7 days of the delivery date. We will send a replacement or issue a full refund — your choice. One email. No forms. We handle it.

5. Returns & Refunds

We stand behind every candle we make. Here's our policy, straight up:

Eligible for return: Unused, unlit candles in their original condition, within 14 days of delivery. Contact us before shipping anything back and we'll give you return instructions. Return shipping costs are the customer's responsibility unless the return is due to a defect or our error.

Not eligible for return:

Candles that have been lit or used
Limited Drop and seasonal items (final sale)
Items purchased at more than 30% off with a discount code (final sale)
Gift cards

Refund processing: Once a return is confirmed or a refund approved, we process it within 1–2 business days. Your bank or card provider may take an additional 3–10 business days to post the credit — that delay is on their end, not ours.

If a scent doesn't smell like what you expected based on our description, reach out. We'll work something out. We'd rather fix it than lose you.

6. Candle Safety & Liability

Our candles are designed to be enjoyed safely when used as directed. By purchasing any Bougie Burn product, you acknowledge that:

You will follow the care and safety instructions provided on our Candle Safety Guide page
You will stop burning any candle when approximately ½ inch of wax remains
You will never leave a burning candle unattended
You will keep candles away from children, pets, flammable materials, and drafts

To the fullest extent permitted by applicable law, Bougie Burn shall not be liable for any indirect, incidental, special, or consequential damages arising from misuse of our products. Our total liability for any claim arising from a product purchase shall not exceed the amount you paid for that specific product.

7. Intellectual Property

Everything on our site — the Bougie Burn name, logo, candle names, scent descriptions, photography, brand copy, and all creative content — is our intellectual property, protected under U.S. copyright, trademark, and trade dress law.

You may share links to our products and pages, and reference our brand name for the purpose of reviewing or discussing our products. You may not reproduce, copy, redistribute, or use our content, imagery, or copy for commercial purposes without our written permission. Unauthorized use of the Bougie Burn name or any confusingly similar mark in commerce is trademark infringement.

8. Wholesale Orders

Wholesale customers are subject to additional terms discussed and confirmed prior to the first order. Our minimum opening order is $150 wholesale, with a minimum reorder of $75. All wholesale terms, lead times, and payment requirements are handled directly — email us at abzaa2021@gmail.com with "Wholesale Inquiry" in the subject line.

9. Privacy

Our use of your personal information is governed by our Privacy Policy, available on our website. We do not sell your personal data to third parties. By using our site, you agree to the collection and use of information as described in our Privacy Policy.

10. Disclaimer of Warranties

Our website and its contents are provided "as is" without warranties of any kind, express or implied. While we work hard to ensure accuracy in all product descriptions, pricing, and availability, we do not warrant that information on our site is error-free or complete. We reserve the right to correct errors or update information at any time.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our site or products shall be resolved in the appropriate courts of San Diego County, California. You consent to personal jurisdiction in San Diego County for the purpose of resolving any such disputes.

12. Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we'll update the "Last Revised" date at the top of this page. Your continued use of our site or purchase of our products after any changes constitutes your acceptance of the updated Terms. If you don't agree with the changes, stop using our site.
